To get a divorce in the State of Texas, you must have been a resident of the State for at least six months and a resident of the County you are filing for at least 90-days.   A divorce must be on file for at least 60 days before it can be finalized. Texas is a community property state and the Court will divide the property in a "fair and equitable" manner. 

As with most areas of law there are some exceptions. 

If you are married and getting a divorce, typically your SAPCR will be incorporated in the divorce pleadings.  

These are also suits that involve parents that are separated but never married, grandparents, or other family member seeking custody. 

Establishing paternity will include this type of proceeding .

These can sometimes be tricky because people move and there may be a change in  the Court that should hear the matter.  The burdens and presumptions have changed since the original proceeding as well. 

Modifications are for changing child support, visitation, conservatorship, or rights and duties. 

These cases are very emotionally charged.  They can also trigger criminal investigations.  Hire an attorney as soon as you are made aware of an investigation or request a Court Appointed attorney if you believe you will qualify.  The sooner the better!

These cases are a mixed blessing.  This office has handled both voluntary and involuntary terminations concluding with an adoption.  We have also had step-parent, open and closed adoptions.  We also register foreign adoptions.  

We can assist you in gestational agreements either for the biological parents or gestational carrier.
